1. What the Services are

COMPASS is the Clinical Orientation and Multi-symptom Patient Acuity Screening System: a guided pre-visit conversation that captures a patient's complete health story, screens responses against evidence-based red flag patterns, and prepares an organized summary for the patient's licensed provider before the visit. The provider portal presents those summaries — with real-time alerts for urgent cases — so clinical teams arrive informed. Our founding principle: AI that enhances — rather than replaces — clinical expertise.

2. Medical disclaimer

COMPASS does not provide medical advice, diagnosis, or treatment. It gathers and organizes the information you share so that a licensed clinician can evaluate you. Nothing produced by the Services — including symptom summaries, red flag alerts, or AI-supported insights — is a medical opinion or a substitute for the judgment of a licensed healthcare professional. Always follow the guidance of your provider, and never delay or disregard professional medical advice because of something you read in the Services.

3. Provider responsibility

For clinicians and clinics using the Services: all clinical decisions remain with licensed clinicians. The Services provide decision support — organized intake, screening summaries, and suggested considerations for the provider to review. Providers are solely responsible for verifying the information presented, exercising independent clinical judgment, and complying with the standards of care, licensure requirements, and laws applicable to their practice. The Services never make a clinical decision.

4. Acceptable use

You agree to use the Services only for their intended purpose. You will not:

• Use the Services for emergencies or as a substitute for professional care;
• Submit information about another person without authority to do so (a parent or guardian completing an assessment for a minor in their care is permitted);
• Attempt to access data, accounts, or clinic queues that are not yours;
• Probe, disable, overload, or circumvent security or access controls;
• Copy, scrape, reverse-engineer, or build a competing product from the Services;
• Use the Services in violation of applicable law, including HIPAA where it applies to you.

5. Accounts and clinic links

Provider and clinic accounts must be created with accurate information, and account holders are responsible for safeguarding their credentials and for activity under their accounts. Clinic-specific assessment links are issued to a particular clinic: assessments started through a clinic link are shared with that clinic — and only that clinic — to prepare for the patient's visit, as disclosed to the patient in the app. Clinics are responsible for distributing their links only to their own patients.

6. Intellectual property

The Services — including the COMPASS assessment flow, red flag detection system, software, design, text, and branding — are the property of ATTENDING AI LLC and are protected by intellectual property law, including USPTO Patent Application #19/215,389 ("AI-Assisted Clinical Decision Support and Automated Treatment Workflow System," filed May 22, 2025) and related continuation-in-part filings. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Services as intended. You retain all rights to the health information you submit; you grant us the limited license needed to process it for the purposes described in our Privacy Policy.

7. No warranty

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any summary or alert is complete or accurate. Clinical information must always be verified by a licensed provider.

8. Limitation of liability

To the fullest extent permitted by law, ATTENDING AI LLC and its founder, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or goodwill, arising from your use of (or inability to use) the Services. Our total liability for any claim arising out of the Services will not exceed the greater of (a) the amount your organization paid us for the Services in the twelve months before the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

9. Termination

You may stop using the Services at any time. We may suspend or terminate access that violates these Terms, threatens the security or integrity of the Services, or creates risk for patients or clinics — with notice where practicable. Sections that by their nature should survive (including Sections 2, 3, 6, 7, 8, and 10) survive termination. Health information retention after termination is governed by our Privacy Policy, our agreements with clinics, and applicable law.

10. Governing law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, and applicable U.S. federal law.

11. Changes to these Terms

We may update these Terms as the Services evolve. We will post the revised version on this page and update the "Last updated" date above; material changes affecting clinic clients will be communicated directly. Continued use of the Services after changes take effect constitutes acceptance.
